Upffront GmbH (“Upffront”, “we”, “us”, or “our”) operates the online shop upffront.com.
These Terms & Conditions explain the rules for buying from us. By placing an order, you agree to them.
2. Placing an Order
When you place an order, you are making an offer to buy the products listed.
Your order becomes a binding contract only when we send you an email confirming that your goods have been shipped.
We may cancel or refuse an order if:
- a product is unavailable,
- there is a pricing or description error, or
- we suspect fraud or unauthorised activity.
You must be at least 18 years old and have legal capacity to enter into a contract.
3. Prices & Payment
Prices on upffront.com are displayed either in euros (€) or, in certain countries such as Denmark, the UK, and the USA, in the local currency for convenience.
All prices include local VAT or sales tax where applicable. For non-EU deliveries, VAT is not charged at checkout, but local import duties or taxes may still apply (see Section 4).
Payment must be made in full at the time of ordering. We accept the payment methods shown at checkout.
When you provide your payment and delivery details, you authorise us to share that information with trusted third parties such as payment processors, fraud prevention providers, and courier services — only for the purpose of processing and delivering your order.
We reserve the right to change prices or correct errors before accepting your order.
4. Delivery, Customs & Duties
We ship worldwide using trusted courier partners. Estimated delivery times and costs are shown at checkout.
Delivery times may be longer for:
- remote destinations such as islands or overseas territories,
- oversized or overlength parcels, or
- customs inspections or other delays outside our control.
If you are importing goods outside the EU, you are responsible for:
- ensuring that the goods can be lawfully imported, and
- paying any customs duties, import VAT, or handling fees charged by local authorities.
Our delivery partners may handle customs clearance for you and invoice any charges directly.
If they do not offer this service, you may need to appoint your own customs agent.
5. Your Right to Cancel (14 Days)
If you are a consumer within the EU or UK, you have the right to cancel your order within 14 days after you receive the goods — for any reason.
You do not need to explain your decision.
To cancel, please notify us clearly (for example, by email) before the 14-day period ends.
You then have another 14 days to send the goods back to us.
You must pay the direct cost of returning the goods unless they are faulty or not as described.
6. Returns, Refunds & Faulty Goods
We refund the full price you paid for the goods plus the cost of standard outbound delivery (not any express upgrade) within 14 days of receiving your return or proof of shipment.
Refunds are made using your original payment method, unless we agree otherwise.
If the returned goods are damaged or show signs of use beyond what is necessary to check them, we may reduce your refund accordingly.
If a product is faulty or not as described, please contact us immediately.
We will arrange repair, replacement, or a full refund at no cost to you.
All goods are covered by a two-year legal guarantee against manufacturing defects from the date of delivery.
For non-EU returns, please contact us first so we can provide the correct re-import paperwork to avoid unnecessary customs charges.
7. Product Descriptions & Availability
We make every effort to ensure product images, descriptions, and specifications are accurate and up to date.
However, colours, finishes, or minor details may vary slightly from the images shown.
All products are subject to availability.
If we cannot supply an item after confirming your order, we will notify you and issue a full refund.
8. Your Account
If you create an Upffront account, you must keep your password secure and ensure your details are accurate and up to date.
You are responsible for all activity under your account.
Please tell us immediately if you suspect unauthorised access or misuse.
We may suspend or close your account if you breach these Terms, misuse the site, or engage in fraud.
9. Intellectual Property
All text, images, product data, and other content on upffront.com — except for content uploaded or shared by users — are owned by Upffront GmbH or our licensors.
The website design, logos, and trademarks are protected by copyright and trademark laws in Germany and internationally.
You may browse and use our website for personal or non-commercial purposes only.
You must not copy, reproduce, modify, or reuse any part of our site or its content without our prior written permission.
10. Limitation of Liability
We are responsible for:
- delivering your goods as described, and
- providing remedies for faulty products under consumer law.
We are not liable for:
- losses that are not caused by our own fault,
- indirect, incidental, or consequential losses (such as loss of profit, business, or data), or
- delays or failures due to events beyond our reasonable control (e.g. strikes, customs delays, transport issues, natural events).
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, such as for injury or death caused by negligence.

We include these links for your convenience only.
Upffront GmbH is not responsible for the content, privacy policies, or practices of any linked websites, and using them is at your own risk.

10B. Website Disclaimer
We do our best to keep upffront.com accurate, secure, and available at all times, but we cannot guarantee that the website or any of its features will always run without errors or interruptions.
The site is provided “as is” and “as available”.
We make no warranties, express or implied, about the accuracy, reliability, or suitability of the information and materials found on the site.
Upffront GmbH cannot be held responsible for any temporary unavailability or technical issues beyond our reasonable control.
Nothing in this section affects your legal rights as a consumer.
11. Promotions & Competitions
From time to time, we may offer price promotions or temporary discounts that are applied automatically at checkout.
Promotional prices are valid only during the advertised period and while stocks last.
We reserve the right to change or end a promotion early if necessary (for example, stock issues or technical errors).
Unless stated otherwise, promotions cannot be applied retrospectively to previous orders.
12. Governing Law & Dispute Resolution
These Terms and all purchases from Upffront are governed by German law, specifically the laws of the State of Schleswig-Holstein.
If you are a consumer in another EU or EEA country, you still enjoy the mandatory protections provided by your local consumer laws.

Appendix – Foredeck Club Terms & Conditions
1. Introduction
These terms apply specifically to membership of the Upffront Foredeck Club (“the Club”) and form an appendix to the Upffront GmbH General Terms and Conditions. By applying for or using Club membership benefits, you agree to these supplementary terms.
2. Membership Eligibility
Membership is open to private individuals aged 18 years or older who are boat owners or sailing enthusiasts. Employees, contractors, and immediate family members of Upffront GmbH or its partners are not eligible to join.
3. Membership Application and Acceptance
Applications are submitted online via the Upffront website. Membership is granted at Upffront’s discretion and confirmed by email. Incomplete or inaccurate applications may be rejected. Membership is personal and non-transferable.
4. Membership Benefits
The Club may offer members exclusive content, events, promotions, early access to products, and other benefits. Details of specific benefits and eligibility criteria will be communicated on the Upffront website or by email. All offers are subject to availability and may be modified or withdrawn at any time.
5. Member Responsibilities
Members must:
- Keep their account details secure and up to date.
- Use membership benefits only for personal, non-commercial purposes.
- Refrain from conduct that could damage the reputation of Upffront or the Club.
Upffront reserves the right to suspend or terminate membership where misuse or breach of these terms occurs.
6. Termination of Membership

Upffront may terminate or suspend a membership without notice where legally justified—for example, in cases of fraud, misuse, or inactivity—or if the Club is discontinued.
7. Modifications to the Programme or Terms
Upffront may amend or withdraw the Club or its terms at any time, providing reasonable notice where possible. Continued membership after notification of changes constitutes acceptance of the new terms.
8. Data Protection
All personal data is processed in accordance with the Upffront Privacy Policy. By joining the Club, members consent to the processing of their information for membership administration and communications about Club-related activities, offers, and events.
9. Liability and Limitations
Membership does not create any legal right to specific benefits. Upffront is not liable for any indirect, incidental, or consequential losses arising from participation in the Club, except where required by law.
10. Governing Law
These terms are governed by the laws of Germany. Consumers resident in another EU Member State retain the protection of their mandatory national consumer rights.
